Terms of Service

These terms are an agreement between you and elSwan Apps ("we", "us"), which runs Christmas HQ at ChristmasHQ.app. By using Christmas HQ, you agree to them. If you don't agree, please don't use it. Our Privacy Policy explains how we handle your family's information.
Who can use Christmas HQ
- You must be 18 or older to create a family, sign in by email or buy a plan. The organizer and Santa's helpers (who see the whole family's gift shopping) sign in by email. A PIN is for other family members and teenagers.
- Children under 13 may not sign in or use Christmas HQ themselves. A grown-up in their family manages their profile and list for them. Teenagers 13 to 17 may sign in with a PIN the organizer gives them, with a parent's or guardian's permission.
- If you're an organizer and you add a child, you confirm that you're their parent or guardian or have their parent's or guardian's permission, that you've marked any child under 13 as under 13, and that you'll supervise their use.
- The organizer is responsible for who they add to the family and for keeping the family code and PINs private.
Your account and your family's content
- Keep your email account secure. Anyone who can open your sign-in emails can sign in as you.
- You own what you and your family put into Christmas HQ: wishes, plans and notes. You give us permission to store it and show it to your family, only to run the service.
- Only add content you have the right to share. Don't upload anything illegal, hurtful or that invades someone else's privacy.
Using the service fairly
Don't try to get into another family's Christmas HQ, get around the surprise protections or plan limits, overload or attack the service, scrape it, or use it to send spam. We may suspend or remove families that do.
Price
- Christmas HQ is free for every family this Christmas season, with every feature included, for up to 40 people. There's no card, trial or subscription, and we never charge you automatically.
- If we decide to offer paid plans in a future season, we'll tell organizers by email and in the app first, with the prices and what's included. Nothing would be charged unless the organizer chooses to pay, and payments would be processed by Stripe.
Changes to the service
We're always improving Christmas HQ, so features may change. We may stop offering Christmas HQ altogether. If we do, we'll give at least 30 days' notice, and a way to save your family's lists.
Ending your use
You can stop using Christmas HQ at any time. The organizer can delete the family in Family settings, and you can delete your own account, as described in the Privacy Policy. We may suspend or end access for anyone who breaks these terms.
Disclaimers
Christmas HQ is provided "as is." We work hard to keep surprises secret and the service running, but we can't promise it will always be available, error-free, or that no one will ever peek. Prices, links and product photos come from shops or from your family, and we don't guarantee they're accurate. As an Amazon Associate I earn from qualifying purchases. A price shown next to an Amazon link is the family's estimate, not Amazon's price, and we don't keep Amazon's product photos. We're not responsible for purchases you make from other websites.
Limit of liability
To the extent the law allows, elSwan Apps isn't liable for indirect or consequential losses, such as a spoiled surprise, a missed delivery or lost data. Our total liability for any claim about Christmas HQ is limited to the amount you paid us in the 12 months before the claim, or $50 if you haven't paid anything. Some places don't allow these limits, so they may not apply to you.
Governing law
These terms are governed by the laws of the State of Iowa, USA, without regard to its conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Iowa, unless the law where you live gives you the right to bring it locally. Please email us first; most problems can be sorted out quickly.
Changes to these terms
If we update these terms, we'll change the date at the top. For important changes, we'll let organizers know by email or in the app before they take effect. Continuing to use Christmas HQ after that means you accept the new terms.
